Terms & Conditions:

FirstCry.com recommends that Participant read these terms and conditions ("Terms and Conditions") carefully prior to entering this contest. By entering this competition an entrant is deemed to indicate his/her agreement to be bound by these Terms and Conditions.

FirstCry.com reserve the rights to change, amend, delete or add to these Terms and Conditions of this event without prior notice. It will be the duty of the Participant to check the campaign site from time to time for any updates/amendments/modifications etc.

1. Applicability: This Contest will be open to all registered account holders ("Participant") subject to the applicable terms and conditions of FirstCry.com, or otherwise. This contest is open to Indian residents only.

Employees, officers and directors of FirstCry.com and its agencies, affiliates, their immediate family members (Parents, spouse, siblings and children) and persons living in the same household of such employees/ officers/directors, are not eligible to participate.

2. Contest Guidelines:

a. Entries must be made in the manner and by the closing date specified. Failure to do so will disqualify the entry.

b. Schedule: The FirstCry Fashionable Mommy-to-be Contest, will be held from 6th to 31st October 2023. Results for the Contest will be announced on 6th November 2023. FirstCry.com reserves the right to extend the Contest deadline at its discretion. If there is a revision, the revised date will be published on the same campaign landing page and all further days for winners will be postponed accordingly.

c. Participant must supply full details as required, and comply with all rules to be eligible to be shortlisted. FirstCry.com shall not be held responsible for ineligible Entries or Entries fraudulently made by the Participant. Proof of age or eligibility is required.

3. Selection Criteria: The contest will be judged by an internal panel of judges identified by FirstCry.com. 2 Lucky Winners will be selected by this panel from the entries. This panel's decision in respect of all matters to do with the competition will be final and binding, and no correspondence or discussions shall be entered into.

4. Prizes:

a. Based on the Decision of the Judges,2 Lucky Winners will be selected.

2 Lucky Winners to Get Ecomama Vouchers worth ₹500 Each

All taxes will be borne by the Winner.

The Winners shall be receive the Gift Vouchers within 30 working days from the result date via email provided by the Participant and shall be informed accordingly. The email sent by Firstcry.com shall have instructions on the further process required to be adhered to by the Winner(s). In the event the Winner(s) fails to adhere to the instructions, that Winner's selection shall be invalidated and FirstCry.com shall not be liable to that Winner(s) in any manner whatsoever and may, at its sole discretion, select another Winner(s).

Contest organizers shall make a total of 2 (two) attempts to contact the Winner as mentioned above. In the event that the selected Winner cannot be reasonably contacted within 15 days from the date of announcement of the Winner, he/she will be disqualified and will not be entitled to any compensation notwithstanding non-receipt of notification hereunder and intimation of selection of an alternative winner by FirstCry.com.

In order to be fair to all the users, a user cannot win Vouchers more than worth Rs. 3,000 within a span of 2 Months. In cases where the user wins the vouchers worth Rs. 3,000 in span of 2 months, the user will not be eligible to win any contests for a span of next 3 months.

5. General Rules:

a. By registering for the event, the Participant agrees to receive any communications in relation to herein in accordance with the applicable law.

b. For an on-going contest, till the time the contest isn’t over and results haven’t been declared, the Participant cannot hide their memories nor can make the entries private as it will result in disqualification. The settings of the memories should be public.

c. The Winners cannot delete the photos which are declared as winner. In case they delete it within span of 3 months, they will be disqualified.

d. Winning entries are non-transferable and non-exchangeable for cash or payment of accounts and may be subject to availability.

e. The Winners of the Contest cannot hide / delete / make the winning entry private. The winning entries need to be present on the Winner section of the Contests for at least 3 months from the day the results are announced. If not adhered to the rules, the Winner’s claim to vouchers/prizes will stand cancelled and if the Winner has already been provided the voucher he/she will be disqualified from all the contests for the next 3 months.

f. Firstcry.com, at any given point of time, reserves the right at its sole discretion to disqualify any Participant or Winner without assigning any reason or giving any prior notification, if the Participant or Winner is found to have breached any Terms and Conditions set out herein or if involved in any fraudulent or unethical practises or transactions on Firstcry.com.

g. Kindly note that at no given point of time, any intimation for disqualification would be sent out by Firstcry.com via mail/SMS/ Call etc.

h. Winner agrees to cooperate with FirstCry.com in fulfilling any legal obligation, if applicable.

i. The Winners will be required to furnish valid, government-issued photo identification and other documentation as required. If these documents are not furnished within the time specified, or if notification is returned as non-deliverable, or if the potential Winner is found to be ineligible or not in compliance with these Terms and Conditions, an alternate Winner will be selected.

6. Data Protection / Privacy Policy: The Participant is deemed to be providing personal information (as required) to FirstCry.com. The Participant hereby warrants that all the information submitted is true, current and complete. FirstCry.com reserves the right to verify the eligibility of the Participant. The Participant agrees to the collection, processing and storage of such personal information by FirstCry.com for purposes of this Contest. The Participant shall be deemed to be familiar with FirstCry.com's privacy policy and user agreement. The event organizer is committed to keep all participants FirstCry.com account, personal information and other sensitive data in the strictest confidence.

7. Limitation of Liability: FirstCry.com cannot accept any responsibility for any damage, loss, injury or disappointment suffered by any Participant entering into the Contest or as a result of being shortlisted. If, for any reason, the Contest (in whole or in part) is not capable of running by reason of damage by computer virus, worms, fraud, bugs, tampering, unauthorized intervention, technical or system limitations or failures, technical malfunction of any network lines, computer on-line systems, servers, or providers, computer equipment or software, failure of any email or entry to be received on account of technical problems or traffic congestion on the Internet, telephone lines or at any web site, or any combination thereof, acts of God or terrorist attacks, hacking, or any other causes which prevents the Participant from participating in this Contest, FirstCry.com shall not be responsible for the same. FirstCry.com and its agencies are not responsible for lost, late, misdirected, incomplete, invalid, corrupted or garbled entries, all of which shall be deemed to be void. FirstCry.com shall not be responsible or liable for any loss or damage whatsoever which is suffered by the Participants (without limitation, indirect or consequential loss, special, incidental, exemplary, punitive damages howsoever caused, including, but not limited to, business interruption or loss of profits, business opportunities, or goodwill arising hereunder even if notified of the possibility of such damage, and notwithstanding the failure of essential purpose of any remedy), or for personal injury suffered or sustained, as a result of the Participants taking part in or winning, except for any liability which cannot be excluded by law. FirstCry.com, its affiliates, employees, directors, agents and other personnel against any claims, losses, damages, expenses (including attorney's fees) which may be raised by any third party. Regardless of the merits of any such claim by a third party, FirstCry.com shall be entitled to proceed on the basis that the Entry breaches these Terms and Conditions and may proceed against the Participant as per legal remedies available. In the event that a selected Entry is shortlisted and/or wins, and is later on challenged by a third party, FirstCry.com shall have the right to disqualify the Participant from participating in this Contest any further.

8. All logos, trade mark and copyrights in relation herein shall be the sole property of FirstCry.com or its licensors, as the case maybe.

9. Failure by FirstCry.com to enforce any of its right hereunder does not constitute a waiver of those rights.

10. These Terms and Conditions are governed by the laws of India and any dispute arising out or in connection with these Terms and Conditions shall be submitted to the exclusive jurisdiction of the courts located in Pune.

11. Apple is not involved in any way with the contest or sweepstakes.
